Site terms of use

1. Introduction

1.1. This document contains important information about the terms (hereinafter the "Terms") governing access to and use of this site, available at www.radeos.org (hereinafter the "Site"), and of the Radeos application available on the Apple Store and Google Play (hereinafter the "Application"), which apply between Radeos Academy, the company that publishes the Site, and every user of the Site and of the Application (hereinafter the "User"). The Site, the Application and their contents are together referred to hereinafter as Radeos.

1.2. Radeos may be used for informational and educational purposes only. Radeos is intended exclusively for qualified healthcare professionals and for those already engaged in a course of training, independent of the Site and of the Application, leading to becoming a healthcare professional. If you are not a qualified healthcare professional or a trainee as described above, we kindly ask you to leave Radeos, which is not intended for you. Radeos cannot, under any circumstances, answer medical questions from the public. Nor is Radeos intended to replace the relationship between a patient and their healthcare professional, or to substitute for that professional's medical opinion. Radeos has been neither tested nor approved for clinical use. Radeos is not a medical device. Radeos may not therefore be used as a diagnostic tool. As a general rule, we recommend that you always seek the opinion of your usual physician before consulting any website presenting medical content.

1.3. By accessing Radeos, or by using services offered on the Site or the Application, you accept these Terms fully and without reservation, and you declare that you are bound by these Terms for an indefinite period, whether or not you are a healthcare professional. They include, in particular, various limitations and exclusions of liability, as well as a jurisdiction clause governing the handling of any dispute. By accessing Radeos, you acknowledge that you have been informed of the Privacy and Data Protection Policy applied by the Publisher, available at https://www.radeos.org/mentions-legales.html on every page of the Site and within the Application. You declare that you do not object to this Privacy and Data Protection Policy implemented by the Publisher.

1.4. This document may be amended at any time and without notice; any amendment is systematically brought to the attention of anyone accessing Radeos through a link available on every page of the Site and of the Application. Any amendment is displayed when the User logs in to the Site and to the Application, and the User must read and approve it before being allowed to continue consulting Radeos. 

1.5. Should you not accept all or part of these Terms, you are asked to refrain from any use of the Site and of the Application and to leave them.

1.6 These Terms apply exclusively to access to and use of Radeos. They do not alter the terms and conditions of any other agreement you may have with the Publisher

 

2. Presentation of the Site and of the Application

2.1. Description and purpose of the Site and of the Application

Radeos is intended exclusively for an audience of qualified healthcare professionals and for those already engaged in a course of training, independent of the Site and of the Application, leading to becoming a healthcare professional (hereinafter the "User(s)"). It is designed for educational purposes and contains medical information (articles, illustrations, tools and other resources, etc.).

2.2. Origin of the Site and of the Application

Radeos is published by Radeos Academy, a simplified joint-stock company (SAS) with share capital of €3,000, whose registered office is at Radeos Academy, 18 Chemin de la Naitoure, 25000 Besançon, France, registered under Trade and Companies Register (R.C.S.) identification number 933 281 776 Besançon (hereinafter the "Publisher").

The publication director of Radeos is Prof. Sébastien Aubry.

The Site is hosted by Ligne Web Service LWS, a limited liability company (SARL) whose registered office is at 4 Rue Galvani, 75017 Paris, France.

2.3. Editorial manager and regular contributors to the Site and to the Application

All users of Radeos may contribute occasionally to supplying the medical information published on Radeos, and follow the rules set out in paragraph "5. Notice to users" of these Terms.

All members of the Radeos scientific board, the full list of which appears at https://www.radeos.org/conseil-scientifique.html contribute regularly to supplying the medical information published on Radeos and, like every user, follow the rules set out in paragraph "5. Notice to users" of these Terms. They also take part in reviewing, correcting and validating the medical information published on Radeos by users who contribute occasionally to supplying that information.

The editorial manager of Radeos is Prof. Sébastien Aubry, Doctor of Medicine, graduate of the Faculty of Medicine of Besançon, specialist qualification (DES) in Radiodiagnosis and Medical Imaging, holder of a D.E.A. (master's degree) in Image Instrumentation and Computing and a Doctorate in Science, Physics option, graduate of the Faculty of Science of Besançon.

2.4. Funding of the Site and of the Application

Radeos is funded by the Publisher, by advertising, by its sponsors and by its industrial partners.

The Publisher's share capital is held by legal entities with no direct or indirect link to the pharmaceutical industry.

 

3. Access to the Site and to the Application

3.1. Free access and registration

The Site is free of charge and openly accessible. The publisher nevertheless reserves the right to restrict access to all or part of Radeos for one or more users, unilaterally and without notice.

Access to certain areas of the Site is subject to prior registration following a procedure explained at that point. Where applicable, the Publisher reserves the right to suspend, limit or refuse access to the Site, unilaterally and without prior notice, to any registered User (hereinafter the "Registered User") who does not comply with the Terms.

3.2. Intellectual property

The Site and the Application each individually consist of a set of instructions, programs and rules. They are the expression of a unique source code created by the Publisher.  Each constitutes an original piece of software within the meaning of the provisions of article L112-2 13° of the French Intellectual Property Code.

The Site and the Application go beyond the mere implementation of automatic logic. Each has lines of programming, code, a structure and a development language that reflect creative choices and an intellectual contribution of the Publisher's own.

The Application is free and freely downloadable from the Google Play and Apple Store platforms. The Site is free and freely accessible at https://www.radeos.org/ 

3.3. Updating & interruption of the Site and of the Application

The Publisher may, at any time, amend or delete information made available on Radeos. It reserves the right to interrupt, suspend temporarily or permanently, or modify access to all or part of Radeos, in order to carry out maintenance or for any other reason, without such interruption giving rise to any obligation or compensation. Access to the Application may also be interrupted or suspended as a result of unilateral decisions by Google Play or the Apple Store.

Product and service specifications are subject to change without notice. Furthermore, the Publisher does not warrant that the products or services listed on Radeos will be available at the time you use the Site and the Application.

3.4. Scope

It is expressly agreed that the use granted allows only consultation of the Site and of the Application, and contribution of medical information to Radeos, in compliance with these Terms in their entirety.

The User acknowledges that these Terms confer on the User no intellectual property right (in particular as a trade mark, design or model) over the Site and the Applications as a whole. Any medical information (text, images, diagrams, drawings) supplied by a User to Radeos is subject to the copyright rules set out in paragraph 5.3, and is the subject of a free-of-charge assignment of all copyright to Radeos. 

3.5. Specific undertakings by users

In using Radeos, the User undertakes in particular not to:

  • share their credentials with another user, each account being for strictly individual use,
  • disrupt or interfere with the security of the Site and of Radeos and of their Content and resources (servers or networks connected to or accessible through the Site),
  • disrupt or impede any other User's enjoyment,
  • upload, display or otherwise transmit through or onto any site any virus or other harmful file,
  • transmit through or onto Radeos any kind of unsolicited bulk email to persons or entities who have not agreed to be included in such mailings,
  • attempt to obtain unauthorised access to Radeos or to parts of Radeos that are access-restricted,
  • use Radeos in order to seek, provide or obtain specific medical advice, a medical opinion or a diagnosis,
  • use Radeos in order to seek, provide or obtain answers and/or private tuition applied to a specific examination in the healthcare field,
  • re-use the content of the Site or of the Applications outside the conditions set out in article 7.2.

 

4. Personal data and confidentiality

4.1. Confidentiality

Personal information concerning visitors to our site, including their identity, is confidential. The Publisher undertakes to comply with the legal confidentiality requirements applicable in France and not to disclose such information to third parties.

4.2. General Data Protection Regulation (GDPR) and CNIL

The GDPR applies to the Publisher as a private entity that collects and/or processes personal data within the territory of the European Union.
In this respect, the Publisher states:

  • that Users are informed when personal data is collected (see 4.3),
  •  that no indirect collection of a user's data is carried out, for example from the Publisher's commercial partners,
  • that no personal data of users is passed on, directly or indirectly, to third parties,
  • and that, should the use of their personal data change, users would be informed by email.

4.3. Collection of personal data

The Publisher offers a set of services (consultation of the entire bank of clinical cases & courses, taking tests, submitting clinical cases, etc.) accessible only to Registered Users. The information supplied on registration is used to identify Registered Users and to manage their participation in the restricted activities of the Site, in particular the submission of clinical cases (sending messages, corrections, etc.). The data concerned relates solely to identity (surname, first name, date of birth, address, email address) and professional life (business address, title). This information is collected on an active basis only. It may be used so that the Publisher can contact the Registered User. It may on no account be used to allow third-party partner companies to contact the Registered User. This information remains strictly confidential and may be disclosed only to an authorised judicial or administrative authority that requests it.

The Registered User expressly warrants the accuracy of the information they provide on registration and undertakes to update it without delay should it change. They are solely responsible for maintaining the confidentiality of the login credentials supplied to them by the Publisher for access to restricted areas. It is their responsibility to take all necessary steps to protect their own data against any harm.

4.4. User's rights

The Publisher undertakes to comply with French Act no. 78-17 of 6 January 1978 on information technology, data files and civil liberties.
In accordance with articles 39 et seq. of that Act, any person may obtain disclosure of, and where appropriate rectification or deletion of, or may object to, information concerning them, by sending an email through the contact form available at https://www.radeos.org/contactez-nous.html

4.5. Statistics

The Publisher subscribes to third-party company services in order to compile statistics on visits to and use of the Site.
These statistics are strictly anonymous and give rise to no processing of personal data.

5. Notice to users, liability and warranty

5.1. Quality of the information supplied

The Publisher endeavours to take the greatest care over the quality of the information supplied on this Site and over its regular updating. The Site may nevertheless present erroneous or inaccurate information despite the Publisher's intention to deliver accurate information. The Publisher draws particular attention to the fact that the information published on the Site is therefore delivered for guidance only and for educational purposes, without express or implied warranty of any kind.

The Publisher assumes no obligation to update the information available on Radeos. The date of publication or, where applicable, of the latest amendment appears clearly on the relevant Radeos page.

The User is solely responsible for the use made of the information placed at their disposal. They are invited to use it with discernment and to apply their own professional judgement in assessing it. The Publisher further advises systematically consulting other sources of information.

5.2. Availability of products or services

Any reference to a Publisher product, application or service on the Site or the Application does not mean that this product or service is or will be available in your country, where it may be subject to regulations and conditions of use. Such a reference implies no intention on the Publisher's part to sell that product, application or service in the User's country. The Site and the Application contain information about products and services that may or may not be available in every country in the world. Before any use of Radeos, the User must satisfy themselves that such use does not infringe the laws of their country of residence.

The User is solely responsible for checking whether the content of Radeos complies with the law of the country from which they access Radeos. They therefore refrain from any use of Radeos contrary to the legal, regulatory or ethical provisions applicable under the law of the country from which they access Radeos. The liability of the Publisher or of any other party involved in the creation and operation of Radeos may therefore on no account be incurred in the event of non-compliance with the law of the country in which the Site or the Application is used.

5.3. Assignment of rights in the User's contributions

Only Registered Users have the ability to supply medical information to Radeos, provided that they comply with these Terms. On Radeos, the Registered User has the ability to submit contributions, which may be of various kinds and consist in particular, without limitation, of images, drawings, diagrams, definitions of medical or anatomical terms, translations, anatomical labels, clinical cases, and so on. These contributions are always voluntary and are made through contribution buttons or links available on the Site and the Applications concerned. Under this document, to which reference is made when such a contribution (hereinafter the "Contribution") is made, the User assigns to the Publisher, on submission of their Contribution, all economic intellectual property rights attaching to their Contribution, for the legal term of protection of those rights and worldwide.

Each User may ask the Publisher to delete the information they have published on Radeos, should they so wish, by sending an email through the contact form available at https://www.radeos.org/contactez-nous.html .  By submitting medical information to Radeos, the user accepts that it may be amended or deleted by the Publisher without their permission. 

In supplying information to Radeos, the Author declares that they are submitting text and images in which they hold the rights. In order to preserve anonymity, any information that would allow an image or a natural person to be identified must be removed before submission: identification numbers, names, initials, dates. Both the Author and the Publisher give their word of honour to comply with the legal confidentiality requirements applying to the medical information held on the server.

Rights assigned : These rights include in particular the rights of reproduction, performance and adaptation, together with the secondary rights as defined below:

5.3.1. Under the right of reproduction

  • The right to reproduce, fix, duplicate, print and record all or part of the Contribution, temporarily or permanently, on any medium, in any format, whether or not associated with other works of whatever nature, of identical or different kind, and whether or not incorporated into such works, this right of reproduction including the right of permanent or temporary reproduction of the Contribution, in whole or in part, by any means and process, in any form, in particular for any loading, display, execution, transmission or storage operation, on any medium known or unknown to date, and in particular digital and opto-digital, magnetic and analogue media, on paper and similar media, using any framing ratio, and this on any site and any application;
  • The right to publish, distribute, market, offer for sale, disseminate, edit and re-edit, exploit, grant or assign usage rights in, rent out and lend, by any means, reproductions of all or part of the Contribution, in its original version or in a version as defined above, in all cases for consideration or free of charge;
  • The right to make and have made, without limitation as to the number of copies, any originals, duplicates or copies, on any analogue and digital medium, in any format and by any process known or unknown to date, from the Contribution.

5.3.2. Under the right of performance:

  • The right to perform, disseminate and exploit all or part of the Contribution in its original version or in a version as defined above, whether or not associated with other works of whatever nature, of identical or different kind, by dissemination over electronic communication networks, by broadcasting and public communication by wire or wireless means, by public projection, by transmission in a public place of the work broadcast or communicated to the public, by public presentation and by any other means;
  •  The right to disseminate or have disseminated the Contribution over the internet and over the mobile telephone network, by any process inherent in that mode of exploitation known or unknown to date, and in particular by reproduction on any computer, digital or opto-digital server, by free on-demand delivery, by streaming involving temporary reproduction without the possibility of downloading by the viewer of the Contribution, by permanent or temporary download, by display on the screens of the terminals used to connect to the internet and whatever the communication channel, mobile telephone line, cable, optical fibre, satellite, Wi-Fi and so on, with a view to communicating the Contribution to the public with or without encryption, for individual as well as collective reception. This right includes in particular advertising use and dissemination on social networks and video hosting sites;
  • The right to broadcast the Contribution, with or without encryption, for individual as well as collective reception, and this by any process inherent in that mode of exploitation;
  •  The right to present the Contribution to the public at events open to the public, exhibitions, public screenings, festivals and promotional events.

5.3.3. Under the right of adaptation and secondary exploitation:

  • The right of translation, arrangement, modification, adaptation, transformation, modulation, compression, change of format and resolution, dubbing, reframing, captioning and commentary in respect of the Contribution, the addition to the Contribution of music, a still image or a sequence of moving images, and the right to create any derivative or composite work incorporating the Contribution or borrowing from the Contribution, in whole or in part and in any written, oral, telematic, digital or other form, for the purposes of all types of exploitation;
  • The right to place on the market, distribute and market any product incorporating the Contribution, whether incidentally or substantially, such as in particular, as regards works of applied art, patterns, product designs, packaging and clothing.

The User further assigns the right to assign or grant to any third party all or part of the intellectual property rights assigned hereunder in the Contribution.

This assignment of rights may not be construed as conferring on the Publisher any obligation to exploit the Contribution.

This assignment is made free of charge, which the User expressly accepts, in view of the absence of exclusivity and of the general interest of the contributions.

The Publisher shall have the right to bring any action to put an end to any infringement or unlawful exploitation of the Contribution.

5.3.4.  Warranties

The User warrants to the Publisher peaceful enjoyment and exercise of the rights attaching to the Contribution and assigned hereunder. They warrant to the Publisher that they are indeed the sole holder of the rights assigned to the Publisher or that, failing this, they have obtained all authorisations necessary for this assignment. They indemnify the Publisher against any disturbance, action, claim, objection, demand, liability, loss, damage, costs or expenses suffered by it in connection with the User's breach hereof, or any demand, action, claim or proceedings brought by a third party asserting that the Contribution infringes or is liable to infringe its intellectual property rights or those of a third party. In such a case, the User would bear all costs incurred by the Publisher in its defence, including any sums it might be ordered to pay by a court decision. 

 

5.4. Exclusion of the Publisher's liability and warranty

Use of Radeos is therefore the sole and entire responsibility of Users. Consequently, the liability of the Publisher or of its partners may not be incurred by reason of any loss or damage, direct or indirect, of whatever nature, arising from access to, use of, even in part, or interpretation of the information on Radeos.

5.5. Liability and warranty of the User of the Site and of the Application

The User indemnifies and holds harmless the Publisher and its partners against any action or claim by a third party by reason of the User's use of Radeos or of any harmful consequences linked directly or indirectly to the use they make of the Site.
The User thus bears in full any damages that the Publisher or its partners might be ordered to pay, together with legal costs and fees incurred.
The User is solely responsible for checking whether the Content of the Site complies with the law of the country from which they access the Site. They therefore refrain from any use of the Site contrary to the legal, regulatory or ethical provisions applicable under the law of the country from which they access the Site. The Publisher's liability may therefore on no account be incurred in the event of non-compliance with the law of the country in which the Site is used.

5.6. Hypertext links

This Site may contain hypertext links to other websites operated by third parties. The Publisher cannot, however, regularly verify the quality of these linked sites. The Publisher may therefore not be held liable for the content of these sites, nor for the services offered on them.

Furthermore, a summary of and/or a link to a third-party site does not imply that the Publisher endorses the site or the products or services on those third-party sites. It does not warrant the accuracy of any content referenced on such a third-party site and will not be liable for loss or damage arising from access, or the inability to gain access, to those sites.

5.7. Advertising

The Publisher undertakes to identify advertising placements clearly with the word "advertising" or a similar term.
The Publisher may subscribe to services offered by third-party companies allowing them to insert advertisements directly and automatically into placements on the Site clearly identified as such. The content of these advertisements nevertheless remains under the Publisher's control, which may remove them from the Site.
Advertisers have no say in the site's editorial content.

 

6. Ownership of the site and of its content

6.1. Protection of the content of the Site and of the Application

All intellectual property rights in the Site and its content (hereinafter the "Content"), consisting in particular of texts, databases, logos, images, drawings, graphics, animated sequences, sounds and videos, are the property of the Publisher or of third parties who have authorised the Publisher to exploit them.
All of this Content is thus protected by French and international legislation, in particular and where applicable on copyright, design rights, trade mark law and database rights.
The names and trade marks mentioned on the Site are marks registered by the Publisher or its rightholders. Any reproduction or imitation and, more broadly, any exploitation of these marks is prohibited, with the exception of the use of the Publisher's marks for the purpose of indicating the origin of content reproduced by the User in accordance with paragraph 6.2 of the Terms.

6.2. Use of the Site and of the Application

This Site is intended exclusively for the User's personal and private use. 

The Publisher grants the User a worldwide, non-exclusive, non-transferable, non-assignable, revocable licence to use the Site and the Applications for the entire term of this agreement and on the conditions set out herein.

The User acknowledges that the Site and the Applications contain proprietary content, information and material protected by the applicable intellectual property legislation, in particular by copyright.

Radeos Academy holds the intellectual property rights, in particular the copyright, in the Site and the Applications. The User acquires only a grant of rights, with no transfer of ownership. 

The Publisher therefore grants the User only a non-exclusive, non-transferable authorisation to browse the Site and to use the Application. The User is authorised to print or download pages of the Site, or to print or take screenshots of pages of the Applications, on the following cumulative conditions:

  • printing or downloading or, where applicable, printing or capture, partially and reasonably (i.e. a maximum of 10% of the Site or of the Application);
  • a prohibition on removing any ownership notice from the content, or on modifying the content;
  • use of the printed, captured or downloaded information only for the User's personal and private use, for non-commercial purposes.

The Publisher further authorises the User a priori to reproduce, in public communications such as blog articles or training courses, reasonable extracts of the content of the Site or of the Applications, which may go beyond the criteria applicable to the short quotation exception.

Such use nevertheless requires the origin of such content to be stated, specifying "Copyright: Sébastien Aubry, Radeos Academy: www.radeos.org" and "Radeos", together with the corresponding logo.

The User must also then notify the Publisher of this reproduction by email, through the contact form available at https://www.radeos.org/contactez-nous.html , as soon as it takes place, so as to allow the Publisher to satisfy itself a posteriori that the use is reasonable, failing which it may, without having to give reasons, require that use of the content cease, which the User must comply with without delay.

Any other use (in particular any reproduction, performance, modification, adaptation or distribution for commercial purposes, whether for profit or not) that does not comply with these criteria is strictly prohibited save with the Publisher's express prior written agreement.

6.3. Hypertext links to the Site

Direct links to internal documents or pages of the Site may not be set up without the Publisher's prior authorisation.

All links to the Site must be approved in writing by the Publisher, except in the following case:

  • the link is a text pointing to the Site's home page and not to inner pages of the Site 
  • the link must display this home page of the Site full screen and not within a frame;
  • the appearance, position and other aspects of the link must not create the false impression that an entity or its activities or products are associated with the Publisher

In any event, the Publisher reserves the right to withdraw its consent to a link without reason, without notice and at any time.

 

7. Miscellaneous provisions

7.1. Term

The Publisher may terminate, modify, suspend or interrupt any access to and use of the Site or of the Application. It may withdraw or modify any content of the Site or of the Application. It may impose limits on certain features and services or restrict access to all or part of the Site or of the Application without notice or liability. The Publisher reserves the right to end the authorisation to use the Site at any time and at its sole discretion.

7.2. Complaints

Any complaint, or any report of abuse or of an infringement of intellectual property rights, must be made in writing to the Publisher's registered office.
In the event of an infringement of intellectual property rights, the following information must be provided:
- Identification, contact details and signature of the owner of the rights declared to have been infringed;
- Where applicable, the authority of that owner's representative for the purpose of issuing the notice of infringement of rights;
- A precise description of the items not complying with that owner's rights whose removal from the Site is requested;
- A sworn statement confirming the accuracy of the information sent to the Publisher.

7.3. No waiver and severability

The fact that the Publisher does not avail itself of a User's breach of any of the legal obligations or of the obligations set out herein may not be construed for the future as a waiver of the obligation in question, or of the right to rely on that breach at a later date.
Should any of the clauses of these Terms be void under any law or other rule of law in force, it shall be deemed unwritten, without this rendering the Terms void as a whole.

7.4. Governing law and jurisdiction

Radeos was designed in France. Radeos is hosted in France. The Terms are governed by French law.
In the event of a dispute concerning the application or interpretation of the Terms, or more broadly the use of the Site by any natural or legal person, it is expressly agreed that the French courts shall have sole jurisdiction, even where there are several defendants or a third-party claim.
